While Biden is leading in the polls, Trump has made it clear that he won’t concede without a fight. Amid a pandemic that has made voting more complicated than ever, Trump and the Republicans are attempting to disqualify votes based on technicalities and baseless charges of fraud. In Texas, Republicans have already attempted to use the legal system to force state officials to throw out over 127,000 ballots cast at drive-through polling places. We should expect many more attacks of this sort. Over the weekend, Trump stated that “as soon as that election is over, we’re going in with our lawyers.”
It won’t be the Democrats or the Supreme Court that stops Trump from stealing the election, but rather the organized resistance of working people. Biden and the Democratic Party are not committing to fight back or mobilize people to defend against Trump’s attacks on basic democratic rights. Both the Democrats and the Republicans are preparing for their respective candidates to win on the basis of legal victory.
This wasn’t a winning strategy for the Democrats in the contested 2000 election between George Bush and Al Gore, where the Democratic Party refused to mobilize any real protest. They left the question of recounting votes up to the legal system, knowing full well that the Supreme Court as well as the courts in Florida were under the control of Republicans. The Supreme Court stopped the recount as it was trending towards Al Gore, with the Democrats still refusing to organize any real opposition. Flash forward to 2020, and 3 out of 9 current Supreme Court justices were part of the legal team that won the Supreme Court case for George Bush in the 2000 election (including Brett Kavanaugh and Amy Coney Barrett).
As we’ve seen time and again, the legal system isn’t neutral and we cannot rely on it to side with the popular vote of working people. Mass action is what has historically won gains for working people, from forcing Trump to back down from his Muslim Ban, to winning legal gains such as Seattle’s ban on police use of chemical weapons and excessive force. Mass action is how we fought against the Washington state legislature’s attempted statewide ban on big business taxes and ultimately won the Amazon Tax.

Working people rejected Trump at the polls, and now it’s up to working people to defend the vote. While Trump is attacking democratic rights nationally, here in Seattle the right wing is trying to overturn the results of last year’s democratic election in District 3 with a big business-backed attempt to recall Councilmember Kshama Sawant. We must build a broad movement to fight back against these attacks on our most basic democratic rights. Join us in the streets tomorrow as we build that movement.
